The market is very busy with lots of prospective tenants looking to move but conversely there is a lot of property on the market and therefore a lot of competition. With so many reluctant landlords (i.e those who would like to sell but can’t get a reasonable offer and therefore choosing to let) the market has been flooded with available properties and it certainly is becoming a tenants market…

All new Gas Safe register…
As of 1St April 2009, the Health and Safety Executive will no longer recognise a landlord’s gas safety certificate issued by a Corgi registered engineer. All gas safety engineers, in order to have their work recognised and certificated, must now be registered on the new Gas Safety Register.
N.B This will not apply to any gas safety certificate issued to you by a Corgi registered engineer before the 1st of April 2009.

Changes to Eviction procedure…
1 April 2009 saw a change to section 11 of the Homelessness etc (Scotland) Act 2003 which means that landlords must notify the relevant local authority when they raise court proceedings for possession of a dwellinghouse in Scotland. The purpose of the new duty is to give local authorities early notice of households who may be at risk of homelessness due to eviction, enabling them to take appropriate action to prevent homelessness or minimise its impact, where possible. ... Energy Performance Certification...
Energy Performance Certificates (EPCs) give information on how to make any property more energy efficient and reduce carbon dioxide emissions. Any property which is advertised for let should have an available EPC report. We have seen record number of properties being let in January and this looks to continue throughout 2009. EPC'S
ENERGY PERFORMANCE CERTIFCATES (EPC'S)
New legislation from the 4th January 2009 is now in force for all properties on the rental market to have a current EPC. Fineholm have secured a local company to carry out EPC'S for a competitive charge.

TENANT'S LOOKING TO RENT ON THE UP
The amount of people choosing to rent rose by nearly 20 per cent over the past three months as the current housing market deterred people from buying a property.
A survey by the Association of Residential Letting Agents (ARLA) showed that around 64 per cent of letting agents outside London said demand for rental property had outstripped the number of homes they had on their books, falling to 41 per cent within the capital.

EPC'S
Energy Preformance Certificates (EPC)
As of the 4th January 2009 all properties on for rental will require an Energy Preformance Certificate (EPC). If your property is let come the 4th January 2009 you will only require to provide and EPC once the property is up for remarketing. The certifcate provides information on the energy efficiency of a building and will suggests cost effective improvements.

Crunch time in Letting...
The current credit crunch in the UK may mean a slowdown for many parts of the economy but the residential letting sector in Scotland is flying at the start of 2008. Citylets has recorded its busiest January to date with the volume of searches launched for property to let in Edinburgh and Glasgow increasing 24.7% and 19.4% respectively on last year.

New Repairing Standards - What does it mean for landlords?
There has been a change in the current legislation according to the Housing (Scotland) Act 2006 which may have an affect on you as a landlord. The changes relate to the repairing standards during a tenancy and the rights of a tenant to contact a newly established Private Rented Housing Panel (PRHP) if they do not believe these standards are being met.
